Health plans must offer a range and scope of addiction/mental health services on part with medical services, but can apply equitable cost containment.  [posted 4.1.2010, Parity Implementation Coalition]

 

We want to be certain that group health plans covered by the Mental Health Parity and Addiction Equity Act* are providing benefits in compliance with the law*. 

If you are a patient or provider who has complaints with a group health plan’s mental health and / or substance use coverage benefits we would like to hear from you. Your reports will help us identify to federal regulators potential patterns of critical concern.

And, depending on the nature of your complaint, we may be able to provide help in resolving your problem or point you to other resources.

Please note that although the interim final regulations went into effect for plan years beginning on or after July 1, 2010, the law has been in effect since October 2009.  Because these regulations were not out by January 1, 2010, plans would only be held to make a good faith effort to be in compliance until the regulations went into effect (7.1.2010), however, plans ARE required to make their best effort  to comply in 2010.

*Unless otherwise specified references to “the Mental Health Parity Act,” “the Parity Act,” or “the Act,” are to The Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008.
